Welcome to Birdasti. The following terms and conditions act as a contract between you and the creator of Birdasti.
The terms (“us”, “we”, or “Birdasti”) refer to the Birdasti mobile application and its sole creator.
By registering for a Birdasti account, whether accessing Birdasti through our website, mobile app, or other offerings (collectively the “Services”), you agree to (i) these Terms of Use, (ii) our Privacy Policy, Arbitration Procedures (if applicable to you), Safety Tips, and Community Guidelines, all of which are collectively referred to as this “Agreement”. If you do not accept and agree to all parts of this Agreement, please do not use the Services. We reserve the right to update this Agreement and the Services from time to time. Updates may occur for various reasons, such as complying with new legal requirements, adding new features, or changing business practices. The latest version of this Agreement will always be available within the Services under Settings. We recommend that you review it regularly, as the most recent version will govern your use of the Services. If any changes significantly affect your rights or obligations, we will notify you either by posting an announcement on our website or by sending an email to the address you provided when registering with Birdasti. These changes will take effect immediately upon posting or sending. It is your responsibility to review the current Agreement and related policies each time you use the Services. Continued use of the Services after any updates means you accept and agree to the revised terms.

You are responsible for keeping your login credentials confidential and for all activities under your account. If you believe your account has been accessed without permission, contact us immediately at support@birdasti.com.
Birdasti "Services” serve as a neutral online platform designed to facilitate exchanges and interactions among property owners also referred to as “landlords”, owner representatives, brokers, property managers, tenants, sub-lessor, potential tenants, potential sub-lessor (collectively referred to as "listed parties"). Birdasti users can utilize the platform to discover and exchange information within the scope of potential real estate transactions and, if they choose, to arrange transactions with each other. Due to the ongoing development of Birdasti, it does not currently provide advice to parties involved in real estate transactions, evaluate the qualifications of potential tenants, or negotiate lease or sale contracts on or through its services. No brokerage relationship, agency relationship, or fiduciary relationship is established between Birdasti and any user of the services. Furthermore, properties listed on Birdasti’s “Services” are subject to various laws and the responsibility of tenants and owners. Birdasti solely facilitates the marketing of real estate for lease, sublease, or potential acquisition among individuals interested in these properties. Birdasti is not responsible for any agreements between its users or for transactions. Individuals using Birdasti’s “Services” must comprehend the existing contracts related to the real estate they are interested in. Users are advised to seek the assistance of a licensed real estate professional and/or real estate attorney to aid in the negotiation and completion of any real estate transaction. By using Birdasti, you acknowledge that you have the permission from your landlords to list your current rental place and that you are solely responsible for the accuracy of the real estate property published, as well as its information regarding its description and rates. You may not, under any circumstances, publish a real estate property for which you don't qualify as any "listed parties." You are solely responsible for the information you disclose with the other party. We have no control over the conduct of our users or the truthfulness or accuracy of the information users post on the "Services”. We do not endorse any person using or registering for our services, whether as tenants or listed parties. We do not verify the information that a user submits to the "Services”. We make no statements about the properties advertised on the "Services”, the listed parties responsible for presenting these properties, the accuracy of the information provided by these listed parties, or the financial capabilities or accuracy of information provided by potential tenants. The "services" constitute an online platform designed for "Listing Parties" seeking residential or commercial real estate rentals, encompassing advertising, listing, and associated services. Birdasti, by design, does not provide financial or real estate services. It does not (i) serve as a property manager, broker, or agent, or (ii) broker, lease, sublease, or own any listings on Birdasti’s "services." Birdasti serves solely as a platform that facilitates the connection of parties interested in leasing, transferring leases with landlords' approval, subleasing with landlords' approval, and potential relocation and/or swapping of places with landlords’ approval. Birdasti is not a participant in any agreement or transaction between Listing Parties and renters, and it does not execute leases on behalf of renters or Listing Parties. Birdasti bears no responsibility for any outcome or consequence arising directly or indirectly from any action or inaction taken based on the Services or any information available through or in connection with the Services unless explicitly stated in the Agreement.
Birdasti may add, improve, or remove features to enhance the Service. If changes don’t significantly affect your rights, we may not notify you. In urgent cases (e.g. security issues, crashes, or critical bugs), we may suspend the Services with or without prior notice. Services will resume once the issue is resolved, but resolution may take time. To delete your account, use the Settings menu. Birdasti reserves the right to terminate accounts without notice for violations. Account termination—whether by user deletion or by Birdasti—ends this Agreement.
Birdasti promotes a respectful member experience but is not responsible for the conduct of any member on or off the Services. You agree to use caution in all interactions with other members, especially if communicating off the Services or meeting in person. Do not provide your financial information or send money to other members.
You are solely responsible for your interactions. Birdasti does not conduct criminal background checks or verify member backgrounds.
You agree to follow all rules and policies published on the Services and use the Services only as outlined in these Terms.

Failure to comply may result in termination of your account and, in some cases, legal action.
Birdasti grants you personal, worldwide access to use the Services. This license lets you enjoy Birdasti under this Agreement. This license is revoked if you:
We may investigate and take legal action for unauthorized or illegal use, including terminating your account.
Software may auto-update; you can control this in your device settings. All software on Birdasti is proprietary. Unauthorized use, copying, selling, or reverse engineering is prohibited except as allowed by this license.
Birdasti’s name, logos, and related marks are owned by Birdasti and cannot be used or copied without permission. The Services belong to Birdasti and are for personal use, except landlords who can use them commercially to list and manage properties.
If your access is ended, you must delete any Birdasti materials you have. You do not own any part of Birdasti’s content or software—only permission to use it. You must follow this Agreement and the law and are responsible for any violations.
You alone are responsible for all data you upload or send via Birdasti’s Services. Only submit data you have authorization to share. Always keep your own backups.

Birdasti isn’t responsible for editing or controlling your data. You retain ownership and rights.
Birdasti may, at its discretion:
We aren’t obligated to store your content—keep your own copies.
You authorize Birdasti to act on your behalf to prevent unauthorized use of your content, including sending takedown notices (e.g., DMCA).
Birdasti provides a platform for tenants to connect, sublet, or transfer leases. We do not provide legal advice, and using our materials does not create an attorney-client relationship. Users are responsible for verifying lease terms and landlord approvals. Birdasti does not verify such permissions nor mediate disputes. You agree to hold Birdasti harmless from any issues arising from your listings or use of materials.
By using Birdasti, you agree to our terms and confirm your listing is accurate and authorized. Properties must comply with all applicable housing, fire, and safety codes. You must remove listings once unavailable. Compliance with fair housing laws is required. Birdasti reserves the right to remove listings that violate our guidelines.
If you collect tenant info (e.g., credit or background checks), you are solely responsible for compliance with applicable privacy and housing laws. Birdasti disclaims responsibility and will not be held liable. You agree to indemnify Birdasti for any legal claims related to your handling of such information.
Birdasti may link to or integrate third-party services. We are not responsible for their content, conduct, or any harm caused. Interactions and payments with third parties are solely between you and them. Listings may also appear on third-party platforms; Birdasti disclaims liability for third-party actions.
Any suggestions or feedback you provide become Birdasti’s property. We may use, share, or implement them without compensation to you.
Birdasti offers services “as is.” We disclaim warranties of merchantability, fitness, and accuracy. We are not liable for indirect, incidental, or consequential damages. Quebec law currently governs, and our liability is limited to the greater of CAD $10 or fees paid in the last 6 months. If Birdasti incorporates in California, California law may apply.
Birdasti operates from Quebec. All disputes are governed by Quebec laws and courts. If Birdasti later incorporates in California, disputes will be governed by California law, and venue will shift to San Francisco. Users must comply with local rental laws and confirm landlord approval before listing.
Currently, Birdasti does not process payments. If payment functionality is added, users will be notified and agree to updated terms governing such transactions.
Birdasti requires only the information necessary to help users find or list rental units. This includes:
- A name to be addressed as.
- An address or location, partial or full, to filter search results geographically.
- A bio for sharing details about yourself or your listing, but avoid sensitive info like phone numbers or full legal names.
- Listing details: rooms, bathrooms, features, availability, price, and images. Non-listing users may upload a profile picture of their choice.
Birdasti collects only what’s needed to operate and improve the platform and never sells or rents your data.
Your data is securely stored with encryption and safeguards, kept only as long as necessary or by law.
We use your data solely to operate, maintain, and personalize the service to help you connect with listings.

Disputes must be resolved through binding arbitration under AAA rules in Quebec (or San Francisco, if incorporated there). No class actions or aggregated claims allowed. Small claims are permitted if jurisdiction is valid. Arbitration awards may be enforced in any court with proper jurisdiction.
